DSA Terms and Conditions
Terms & Conditions Agreement for DSA:
1. Non-Charging of Customers
As a DSA for Finwiser, you are strictly prohibited from directly charging or demanding payment from customers. Any such action will be considered fraudulent and subject to legal consequences. Finwiser reserves the right to take legal action, which may include termination of the agreement and filing a suit in the appropriate court.
2. Lead Generation and Processing
Finwiser will provide you with leads that come through our user database. The leads are processed through several stages:
- The leads are captured by our system.
- Our executive team contacts the customer and convinces them of the product or service.
- The lead is then passed on to our local partners or employees, who will forward it to you, the DSA.
- Your responsibility is to hand over the lead to the respective bank or financial institution for further processing.
3. Payout Distribution
In the lead processing journey, multiple individuals are involved. Once a lead is finalized and a payout is received from the bank, the payout will be divided among the participants in the process (up to four hands). You will be responsible for sharing 50% of your payout from the bank with Finwiser.
4. Commission Policy
Finwiser maintains a flexible commission policy. We charge the customer for loans based on their profile and type. This may range from 0% to 2%, depending on the specific case.
5. Feedback and Accountability
Finwiser conducts strict feedback and complaint management after product disbursement or in the event of non-disbursement. If a customer lodges a complaint against you for inappropriate behavior, non-transparency, or any breach of professional conduct, we will investigate the matter thoroughly. If found at fault, Finwiser reserves the right to terminate your DSA agreement.
6. No Direct Business
You are not permitted to engage directly with customers regarding payments or financial discussions without the prior approval of Finwiser. All communication and processes with the customer must go through the appropriate Finwiser channels.
7. Bank’s Responsibility in Lead Processing
Finwiser's partnership with various banks and financial institutions means that you will submit leads directly to these institutions. However, Finwiser holds the right to monitor and control how these leads are handled. You must ensure complete transparency and compliance with the bank’s rules and Finwiser’s policies.
8. Ethical Conduct and Compliance
You are expected to conduct yourself with the highest level of professionalism and integrity. Any misrepresentation, misinformation, or fraudulent activity will lead to immediate termination and legal action. This includes non-disclosure of key information to customers or misleading them in any form.
9. Confidentiality Agreement
As a DSA, you will be privy to sensitive customer information. You are required to maintain strict confidentiality regarding all customer data. Misuse or sharing of this data without authorization will be subject to legal penalties.
10. Dispute Resolution
Any disputes arising between Finwiser and the DSA shall be handled through amicable negotiations. In case of failure to reach an agreement, the dispute will be subject to arbitration or legal proceedings under the jurisdiction of [City].
11. Non-Refundable Payouts
Once a payout has been made to the DSA, it is considered non-refundable. In case of an error or discrepancy, the matter will be reviewed by Finwiser on a case-to-case basis.
12. Blood Relations Exemption
As part of Finwiser's policy, we do not charge our co-workers or employees in cases involving direct blood relations. If you are involved in processing such leads, you must inform Finwiser management in advance.
13. Adherence to Regulatory Guidelines
You are required to comply with all applicable banking, financial, and government regulations in your dealings as a DSA. Any failure to do so may result in fines, penalties, or termination of this agreement.
14. Exclusivity Clause
As a DSA, you are not permitted to work for any other company offering similar services unless explicit written permission is granted by Finwiser. This ensures that our business interests are protected and there is no conflict of interest.
15. Termination Clause
Finwiser reserves the right to terminate your agreement at any point, should there be any violation of the above terms, unethical behavior, or dissatisfaction from customers or partner banks. Upon termination, all pending payments will be processed in accordance with the terms set forth herein.
